These Terms & Conditions (“Terms”) govern your access to and use of the Snoutiq website and mobile application (together, “Snoutiq” or the “Platform”), operated by Thinktail Global Pvt. Ltd. (“Thinktail,” “we,” “us,” or “our”). By accessing or using Snoutiq in any way—whether as a Guest, Registered User, Seller, Veterinarian, Clinic, or other Provider—you (“you” or “User”) agree to be bound by these Terms. If you do not agree with any provision herein, please stop using Snoutiq immediately.

1. Definitions

  1. “Snoutiq” or “Platform” means the Snoutiq website and mobile application, including all features, content, and functionality.
  2. “Company,” “we,” “us,” or “our” refers to Thinktail Global Pvt. Ltd., a company incorporated under the laws of India, with its registered office at Plot No. 20, Block H-1/A, Sector-63, Noida-201301, Uttar Pradesh, India.
  3. “User,” “you,” or “your” means any individual or entity accessing or using Snoutiq in any capacity.
  4. User Categories:
    • “Guest User”: Any person browsing or accessing Snoutiq without registering an account.
    • “Registered User”: A User who has created an account on Snoutiq by providing name, phone number, and email address.
    • “Seller”: A registered legal entity or individual (including Veterinarians, Clinics, or other Providers) that lists and sells pet products or services on Snoutiq. Sellers must complete KYC (Know Your Customer) verification, providing relevant licenses and certifications.
    • “Veterinarian”: A Seller who is licensed to provide veterinary consultations (video or in-person). Technically categorized under “Seller” but subject to additional licensing and professional requirements.
    • “Clinic”: A physical or virtual facility (also a Seller) where veterinary or grooming services are offered.
    • Additional Terms: In these Terms, “Provider” may refer collectively to Veterinarians, Clinics, Groomers, or any third-party service providers.

2. Acceptance & Eligibility

  1. Agreement to Terms. By accessing or using any part of Snoutiq, you confirm that you have read, understood, and agree to these Terms (including any updates we publish). If you do not agree, you must immediately cease all use of Snoutiq.
  2. Eligibility. There is no age limit to browse Snoutiq; however, to purchase products or services (including booking consultations), you must be legally capable of entering into contracts under applicable law. When registering as a Seller or Provider, you must be at least 18 years old and provide valid government-issued identification, applicable professional licenses (for Veterinarians), and any other documentation we request for KYC.
  3. Account Registration.
    • Guest Use: You may browse (view) product listings, medical articles, and general content on Snoutiq without registering.
    • Registration Requirements: To purchase items, book services, or list products/services, you must register by providing your name, phone number, email address, and creating a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
    • Verification for Sellers/Providers: All Sellers (including Veterinarians and Clinics) must submit and maintain valid professional licenses, certifications, or proof of legal right to sell/offer services. We reserve the right to suspend or refuse any application that fails verification.
    • Accurate Information: You agree to provide accurate and up-to-date information. Failure to do so may result in suspension or termination of your account.

3. Platform Services & Scope

  1. Marketplace Functionality. Snoutiq enables:
    • Browsing & Listing Products: Pet food, toys, medicines, supplies, and accessories.
    • Booking Services: Video and in-person veterinary consultations; grooming; training; boarding; and other pet-related services.
    • Accessing Medical Content: Articles, guides, dosage calculators, treatment overviews, and educational materials.
  2. Payment Processing & Escrow.
    • Accepted Methods: Snoutiq accepts all major credit/debit cards, UPI, digital wallets, net banking, and other methods displayed at checkout.
    • Escrow Mechanism: When you place an order for a product or book a service (consultation, grooming, etc.), your payment is collected and held in escrow by Thinktail. Funds are released to the Seller/Provider only after confirmation of delivery or completion of the service (e.g., Veterinarian confirms consultation took place).
    • Pricing & Commissions:
      • Veterinarian Consultation Fees: Sellers (Veterinarians) set their own consultation rates. Thinktail charges a 7% commission for “Early Adopter” Veterinarians (for the first two months after onboarding) and 10% thereafter.
      • Products & Supplies: Sellers set product prices; Thinktail charges a 20% commission on pet medicines, food, toys, supplies, and other retail items.
      • Membership Plans: Providers (Veterinarians, Groomers, Clinics, etc.) may subscribe to the Premium Provider Plan at ₹5,999 per month for enhanced visibility, priority listing, access to analytics, and other premium features. Thinktail retains the membership fee in full.
    • Refunds & Chargebacks: All refund requests and chargebacks are governed by our Cancellation & Refund Policy (see Section 7). We reserve the right to deduct commissions, fees, or chargeback amounts from your escrow or future payouts if a legitimate refund or chargeback occurs.
  3. Order Fulfillment & Delivery.
    • Seller Responsibilities: Sellers must prepare and hand over products to a third-party courier partner (e.g., Blinkit, Porter) within five (5) hours of order confirmation. Sellers are responsible for proper packaging, compliance with shipping regulations (especially for temperature-sensitive or medical items), and transferring possession to the courier.
    • Courier Responsibility: Once the courier accepts the package, responsibility for transit resides with the courier. Estimated delivery timelines vary by location; Sellers should communicate expected delivery dates to Buyers.
    • Service Scheduling: Video consultations are available instantly (subject to Veterinarian availability). In-person consultations or grooming appointments are scheduled within a window of ±30 minutes to 3 hours of the chosen time slot, depending on the Provider’s availability. Users are responsible for ensuring they—and their pets—are available within that window.
    • Order Cancellation Prior to Dispatch: Buyers may cancel an order before it is handed to a courier; Sellers must refund according to our Cancellation & Refund Policy. Once an item is with the courier, cancellation must follow that policy’s terms.
    • Inspections & Damages: Upon delivery, Buyers should inspect items immediately. Any damage, defect, or missing item must be reported to Seller (via in-app messaging) and Customer Support within 24 hours. Otherwise, disputes may not be honored.

4. User Responsibilities & Code of Conduct

  1. General Obligations. When using Snoutiq, you agree to:
    • Provide complete, accurate, and lawful information.
    • Keep your account credentials secure; immediately notify us of any unauthorized access.
    • Comply with all applicable laws, regulations, and professional standards (especially when providing medical advice or treatment).
    • Communicate and transact in a professional, truthful, and respectful manner.
  2. Prohibited Conduct. You may not, under any circumstances:
    • Use Snoutiq for any unlawful purpose or to promote illegal activities.
    • Upload or distribute any content that is defamatory, discriminatory, harassing, obscene, or infringing on any third-party rights.
    • Attempt to disguise your identity, create multiple accounts, or misrepresent your affiliation.
    • Post false, misleading, or fraudulent listings or reviews.
    • Attempt to bypass or manipulate our payment, escrow, or dispute resolution mechanisms (e.g., requesting off-Platform payments).
    • Access or attempt to access data belonging to other Users, Sellers, or Providers without authorization.
    • Introduce viruses, malware, or other harmful code to Snoutiq.
    • Interfere with or disrupt the operation of Snoutiq (e.g., denial-of-service attacks, excessive bots, scraping).
  3. Seller/Provider-Specific Obligations. In addition to the above, Sellers and Providers must:
    • Maintain valid licenses, certifications, and insurance (as required by applicable law). Upload documentation for our review and promptly update any expired or revoked credentials.
    • Provide accurate, up-to-date descriptions, images, and pricing for all products and services.
    • Fulfill orders and appointments in a timely, professional manner.
    • Handle sensitive medical data (pet health records, owner medical history) in compliance with applicable privacy laws (e.g., India IT Act, rules on sensitive personal data).
    • Refrain from prescribing, dosing, or recommending prescriptions for any condition without a proper veterinary consultation.
    • Comply with all applicable health, safety, and biosecurity guidelines (e.g., packaging of medications, disposal of medical waste).

5. Intellectual Property

  1. Ownership by Thinktail. All Snoutiq content—such as logos, trademarks, text, graphics, software, code, sound recordings, videos, designs, and “look and feel”—is owned by Thinktail or its licensors. All rights are reserved.
  2. Seller/Provider Content. By uploading any photographs, images, articles, guides, or other content (“User Content”) to Snoutiq, Sellers and Providers represent and warrant that they either own all rights to that content or have obtained all necessary licenses, consents, and permissions. By posting, you grant Thinktail a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works, display, and perform the User Content in connection with operating and promoting Snoutiq.
  3. Limited License to Users. Subject to your compliance with these Terms, Thinktail grants you a limited, non-exclusive, non-transferable, revocable license to access and use Snoutiq’s content for your personal, non-commercial purposes. Any other use (e.g., copying, modifying, distributing, retransmitting, or displaying any content) without our express written consent is strictly prohibited.
  4. Feedback. If you provide us with any suggestions, feedback, or ideas regarding features, functionality, or design (“Feedback”), you acknowledge and agree that we may use, implement, modify, and commercialize such Feedback without any obligation or compensation to you.

6. Medical Information & Disclaimers

  1. Educational Purposes Only. Snoutiq may contain medical articles, dosage calculators, treatment overviews, and other veterinary-related content intended solely for educational purposes. Such information does not constitute veterinary advice, diagnosis, or treatment and should not replace a consultation with a licensed veterinarian.
  2. No Guarantees. We do not guarantee the accuracy, completeness, or currency of any medical content. Reliance on any information provided through Snoutiq is solely at your own risk.
  3. No Doctor-Patient Relationship. Viewing or using medical content does not create a doctor-patient (veterinarian-pet) relationship between you (or your pet) and Thinktail or any Providers on Snoutiq. Only a direct, real-time consultation (video or in-person) with a licensed Veterinarian establishes such a relationship.
  4. Limitations of Liability. Thinktail and its affiliates, officers, directors, employees, and agents disclaim all liability for any outcomes—adverse or otherwise—arising from your use of medical information on Snoutiq. Always seek the care of a qualified veterinarian for questions about your pet’s health, diagnoses, or treatments.

7. Fees, Payments, Cancellations & Refunds

  1. Fees & Commissions.
    • Product Sales: Sellers set their own retail prices; Thinktail collects a 20% commission on each product sale.
    • Veterinarian Consultations: Sellers (Veterinarians) set consultation fees. Thinktail charges a 7% commission for “Early Adopter” Vets (first two months after onboarding) and 10% thereafter.
    • Other Services (Grooming, Training, Boarding): Sellers set service fees; Thinktail retains a 20% commission on all non-medical pet services.
    • Membership Plans: Providers may subscribe to the Premium Provider Plan for ₹5,999 per month. Thinktail retains this fee in full.
  2. Payment Collection & Escrow.
    • All payments made by Buyers are collected by Thinktail and held in escrow until delivery or completion of the service.
    • Once the Seller confirms order fulfillment or service delivery, Thinktail releases the funds (less commissions and any applicable fees) to the Seller’s designated payout account.
  3. Invoices & Taxation.
    • Thinktail will generate an invoice for each transaction detailing item(s)/service(s) purchased, the Seller’s price, the commission amount, taxes (if applicable), and the total.
    • Sellers are responsible for reporting and remitting any applicable sales tax, GST, professional tax, or any other tax obligations under Indian law. Thinktail may collect and remit taxes on behalf of Sellers when legally required.
  4. Cancellations & Refunds.
    • Pre-Dispatch Cancellations: Buyers may cancel product orders before the Seller hands them to the courier. Sellers must refund in full (including shipping charges) within seven (7) business days.
    • Post-Dispatch Cancellations: Once the product is in transit, cancellations follow the Seller’s shipping carrier’s return policies. Buyers may incur return shipping fees unless the item is defective or the wrong item was sent.
    • Service Cancellations:
      • Veterinary Consultations: Buyers may cancel or reschedule up to two (2) hours before the scheduled time for a full refund. Cancellations within two (2) hours of the appointment or no-shows are non-refundable.
      • Grooming & Other Services: Cancellation policies vary by Provider; however, in general:
        • Cancellations made more than 24 hours before the appointment incur a full refund.
        • Cancellations made between 2 to 24 hours before incur a 50% refund.
        • Cancellations within 2 hours or no-shows are non-refundable.
      • Snoutiq will display each Provider’s cancellation terms at booking; Providers must honor those terms.
    • Refund Processing: All approved refunds (for products or services) are processed to the original payment method within 7–10 business days.
    • Chargebacks: Any chargebacks initiated by Buyers due to dissatisfaction must first follow our in-Platform dispute process. If a legitimate chargeback occurs, Thinktail reserves the right to recover funds (including commissions) from the Seller or debit future payouts.
  5. Disputes & Resolution.
    • If a Buyer is dissatisfied with a product or service, they must contact Customer Support ([email protected]) within 24 hours of delivery or completion. We will mediate disputes in good faith.
    • If mediation does not resolve the issue, Users may pursue formal dispute resolution as outlined in Section 12 (Dispute Resolution).

8. Limitation of Liability & Indemnification

  1. Disclaimer of Warranties.
    • SNOUTIQ AND ALL CONTENT, PRODUCTS, AND SERVICES OFFERED THEREIN ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” THINKTAIL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
    • THINKTAIL DOES NOT GUARANTEE THAT SNOUTIQ WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
    • THINKTAIL DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER-GENERATED CONTENT (E.G., REVIEWS, RATINGS), MEDICAL ARTICLES, OR THIRD-PARTY LINKS.
  2. Limitation of Liability.
    • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THINKTAIL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION), ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) SNOUTIQ, EVEN IF THINKTAIL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    • THINKTAIL’S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, SNOUTIQ, OR ITS CONTENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO THINKTAIL IN THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.
  3. Indemnification. You agree to indemnify, defend, and hold harmless Thinktail and its affiliates, officers, directors, employees, agents, and licensors (collectively, the “Indemnified Parties”) from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
    • Your use of (or inability to use) Snoutiq.
    • Any content you submit, upload, or post, including User Content and any infringement of third-party rights.
    • Your breach or alleged breach of these Terms.
    • Your violation of any applicable law, rule, or regulation.
    • Any injury or damage caused by your pet or by any products/services you sell via Snoutiq.

9. Account Suspension & Termination

  1. Termination by You. You may close your account at any time by contacting Customer Support at [email protected].
  2. Suspension or Termination by Thinktail. We reserve the right, in our sole discretion, to suspend or terminate your access (including access to certain features) or your account—temporarily or permanently—if you breach any provision of these Terms, provide false information, or engage in fraudulent or unlawful activities. We may also remove any listings, content, or User Content we believe, in our sole discretion, violate our policies.
  3. Effect of Termination.
    • Upon termination, your right to use Snoutiq immediately ceases.
    • Thinktail may retain certain information (including transaction records and communications) to comply with legal obligations, resolve disputes, and enforce our agreements.
    • You are still responsible for any outstanding fees, commissions, or other amounts owing up to and including the date of termination.

10. Privacy & Data Protection

  1. Privacy Policy. Our Privacy Policy (available at [Link to Privacy Policy]) explains how we collect, use, share, and protect your personal information. By using Snoutiq, you consent to the collection and use of your data as described therein.
  2. Medical & Sensitive Data. If you (or your pet) provide any medical or health-related information (e.g., pet health history, medical records), you explicitly consent to our collection, storage, and processing of that information to facilitate consultations and provide educational content. We will treat all sensitive personal data in accordance with applicable laws (including India’s IT Act and rules on “sensitive personal data or information”).
  3. Data Retention. We may retain your data for as long as necessary to provide Snoutiq and comply with legal obligations, resolve disputes, enforce our agreements, or for legitimate business purposes. Upon request and where required by law, we will delete or anonymize your personal data.

11. Modifications to Terms & Snoutiq

  1. Changes to Terms. We may revise these Terms at any time. When we do, we will post the revised Terms on Snoutiq with an updated “Last Updated” date and send an email notification to all Registered Users at least seven (7) days before changes take effect. Your continued use of Snoutiq after the effective date of the revised Terms constitutes acceptance of those changes.
  2. Changes to Snoutiq. We reserve the right to modify, update, or discontinue any aspect of Snoutiq (including features, services, or content) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of Snoutiq.

12. Governing Law & Dispute Resolution

  1. Governing Law. These Terms and any claim, dispute, or controversy (whether in contract, tort, statute, regulation, or otherwise) arising out of or in connection with these Terms or your use of Snoutiq will be governed by and construed in accordance with the laws of India, without regard to conflict of laws principles.
  2. Informal Resolution. In the event of any dispute, controversy, or claim arising out of or relating to these Terms, you and Thinktail agree to attempt to settle the dispute amicably through good faith negotiations. If we cannot resolve the dispute within 30 days after one party notifies the other in writing, the parties agree to proceed as follows:
    • Arbitration: Any unresolved dispute shall be finally submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi, India. The arbitration proceedings shall be conducted in English, with a sole arbitrator mutually appointed by the parties. The award rendered by the arbitrator shall be final and binding on both parties and may be enforced in any court of competent jurisdiction.
    • Court Jurisdiction: Notwithstanding the foregoing, either party may seek interim or injunctive relief in the courts of competent jurisdiction in New Delhi, India, to protect its intellectual property rights or confidential information.
  3. Class Action Waiver. To the fullest extent permitted by law, you and Thinktail agree that any claim you have against Thinktail must be resolved individually and you expressly waive any right to pursue a claim on a class-, collective-, or representative-action basis.

13. Notices & Communications

  1. To Users. We will provide notices to you by email (to the email address you provided upon registration) or by posting notices on Snoutiq.

  1. Electronic Communication. By using Snoutiq, you consent to receive communications (including notices, agreements, disclosures, or other information) electronically.

14. Miscellaneous

  1. Severability. If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid, enforceable provision that most closely matches its intent.
  2. Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized Thinktail representative.
  3. Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Thinktail may freely assign these Terms (in whole or in part) to any successor or affiliate without notice.
  4. Entire Agreement. These Terms, together with any documents they expressly incorporate (e.g., Privacy Policy, Cancellation & Refund Policy), constitute the entire agreement between you and Thinktail concerning the subject matter herein, superseding all prior or contemporaneous agreements, written or oral, between the parties.

By clicking “I Agree,” continuing to access, or using Snoutiq, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms;
  • You have the capacity to enter into legal agreements under applicable law; and
  • You accept Snoutiq’s policies, procedures, and guidelines.
